These Terms & Conditions (Terms) govern your access to and use of our website (the Website) and any purchase of products or services we offer. By using the Website or placing an order, you agree to be legally bound by these Terms.

Important: These Terms include provisions that limit our liability (to the extent permitted by law), explain when title and risk pass, and set out our approach to returns. Nothing in these Terms limits any rights you may have under the Australian Consumer Law (ACL).


1. Overview

1.1 We operate the Website and offer pre-owned and/or new watches, straps, accessories and related items (each a Product), and may also offer services such as sourcing, procurement, trade-in facilitation, and/or consignment sale administration (each a Service).

1.2 If you do not agree to these Terms, you must stop using the Website and must not place an order.

2. Changes to these Terms

2.1 We may update these Terms from time to time by posting the updated version on the Website.

2.2 Unless required by law, changes will not apply retrospectively to orders accepted before the updated Terms were posted.

3. Eligibility & acceptable use

3.1 You must be at least 18 years old (or have the consent of a parent/guardian) to place an order.

3.2 You agree not to misuse the Website, including by introducing malware, attempting unauthorised access, scraping in a manner that disrupts the Website, or using the Website for unlawful purposes.

3.3 If you create an account, you are responsible for maintaining the confidentiality of your login details and for activities conducted using your account.

4. Products, condition & authenticity

4.1 Pre-owned nature: Many Products we sell are pre-owned. Signs of wear consistent with age and use may be present. Product condition is assessed with regard to the Product’s age, model, materials and typical use.

4.2 Descriptions & photos: We aim to describe Products accurately and show clear photographs. However, colour/texture may vary between screens and in person.

4.3 Scope of supply: What is included (e.g., box, papers, spare links, straps, tools) will be described on the Product page and/or your order confirmation.

4.4 Authenticity: We undertake authentication steps we consider appropriate for the Product (which may include inspection, internal assessment and research). We do not represent that we are an authorised dealer for any manufacturer unless expressly stated.

4.5 Water resistance & timekeeping: Unless we expressly state otherwise in writing, water resistance is not guaranteed and should be tested/confirmed before exposure to water. Timekeeping performance can vary based on wear, service history, movement type, and environment.

4.6 Brand owners: Brand names and trade marks are the property of their respective owners. We are not affiliated with, sponsored by, or endorsed by any brand owner unless expressly stated.

5. Pricing, GST & currency

5.1 Prices are displayed on the Website and may change at any time before you place an order.

5.2 Unless stated otherwise, prices are shown in Australian Dollars. Any GST (where required) will be shown at checkout for Australian deliveries.

5.3 If an obvious pricing or listing error occurs, we may correct the error and cancel/refund an affected order (or contact you to confirm whether you wish to proceed at the correct price).

6. Orders & payment

6.1 Order process: By placing an order online or in person (an Order), you make an offer to purchase the Product(s) subject to these Terms.

6.2 Acceptance: We may accept, reject, or cancel an Order at any time (including for stock availability, suspected fraud, payment verification issues, pricing errors, or other reasonable operational reasons). If we cancel an Order after payment, we will refund amounts paid for the cancelled Order.

6.3 Payment: We accept payment methods made available at checkout and/or communicated in writing for in-person Orders. Payments may be processed by third-party payment processors.

6.4 Verification: For high-value transactions or where reasonably required to protect customers and our business, we may request additional verification (e.g., identification, proof of address, or payment verification). We may cancel and refund an Order if verification is not provided within a reasonable timeframe.

6.5 Fees: If any card surcharge or similar fee applies, it will be displayed at checkout (or advised before processing an in-person payment).

6.6 Promotions: Promotions (if offered) apply only as stated, cannot be applied retrospectively unless we agree in writing, and may be withdrawn at any time.

7. Consignment items

7.1 We may offer some Products for sale on consignment on behalf of third-party owners (a Consignor). If a Product is sold on consignment, Wristory acts as agent/consignee facilitating the sale.

7.2 The same customer protections under the ACL may apply depending on the circumstances and the nature of the supply. Nothing in these Terms excludes non-excludable consumer rights.

8. Sourcing / procurement requests

8.1 If you request that we source a Product for you, any sourcing fee, deposit, timelines, and acceptance criteria will be set out in writing.

8.2 Unless we agree otherwise in writing, sourcing fees may be non-refundable once sourcing work has commenced (subject always to your ACL rights).

9. Collection

9.1 If collection is offered and selected, we will notify you when the Order is ready and provide collection instructions.

9.2 You may be required to present identification and/or the payment method used for verification at collection.

10. Shipping & delivery

10.1 Address accuracy: You are responsible for ensuring delivery details are correct. Additional redelivery or rerouting fees charged by carriers may be payable by you.

10.2 Dispatch timeframes: Any dispatch timeframes are estimates only. We are not liable for delays outside our reasonable control (e.g., carrier delays, customs processing, extreme weather).

10.3 Tracking & signature: We may ship with tracking and signature-on-delivery for security.

10.4 International orders: If we ship internationally, you are responsible for customs duties, import taxes, and related charges imposed by the destination country, unless we expressly agree otherwise in writing.

10.5 Transit issues: Please inspect your delivery promptly. If an item appears damaged in transit or missing, contact us as soon as practicable with photos and packaging details so we can assist with a carrier claim where available.

11. Title & risk

11.1 Title: Title in the Product(s) does not pass to you until we receive full payment in cleared funds.

11.2 Risk: To the extent permitted by law, risk passes to you when the Product is collected by you (collection orders) or when the Product is handed to the carrier for delivery to your nominated address (delivery orders).

12. Returns & refunds

12.1 Change of mind: We do not have to provide a refund for change of mind under the ACL. Unless we agree otherwise in writing, we do not offer refunds for change of mind, incorrect selection, or because you later decide you do not want the Product.

12.2 Exceptions: Any voluntary return we offer does not limit your rights under the ACL for faulty goods or other issues where the consumer guarantees apply.

13. Consumer guarantees (ACL)

13.1 Our goods come with consumer guarantees that cannot be excluded under the ACL.

13.2 If a Product fails to meet a consumer guarantee, you may be entitled to a remedy such as repair, replacement or refund depending on whether the failure is major or minor, and you may also be entitled to compensation for reasonably foreseeable loss. (This is a summary only.)

13.3 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL or any other applicable law that cannot be excluded.

14. Trade-ins / buy-backs

14.1 If you ask us to buy back or accept a trade-in of a Product, any offer price is determined by us in our discretion (acting reasonably) based on factors such as condition, completeness, market demand and our costs/risks.

14.2 Unless agreed in writing, trade-in/buy-back offers are time-limited and may be withdrawn if circumstances change (including market pricing, condition changes, or verification outcomes).

15. Intellectual property

15.1 We own or license the content on the Website, including photos, videos, text, design, and code (the Content).

15.2 You may view the Website and print extracts for personal, non-commercial use. You must not reproduce, distribute, or exploit Content for commercial purposes without our prior written permission.

16. Third-party links

16.1 The Website may contain links to third-party websites. We do not control and are not responsible for third-party content, availability, or privacy practices.

17. Privacy

17.1 We handle personal information in accordance with our Privacy Policy.

17.2 We may use third-party service providers (e.g., payment processors, couriers, fraud prevention tools) to provide the Website and fulfil Orders.

18. Liability & indemnity

18.1 General limitation: To the maximum extent permitted by law and subject to your non-excludable rights (including under the ACL), we exclude liability for indirect or consequential loss, loss of profit, loss of opportunity, and loss of data.

18.2 Maximum liability: To the extent permitted by law, our total aggregate liability for any claim relating to a Product is limited (at our option) to resupplying the Product, repairing the Product, replacing the Product, or refunding the amount you paid for the Product.

18.3 Indemnity: You indemnify us from and against claims and losses arising from your unlawful act or your material breach of these Terms, except to the extent we caused or contributed to the loss.

19. Governing law

19.1 These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

20. Definitions

ACL means Schedule 2 (Australian Consumer Law) to the Competition and Consumer Act 2010 (Cth).

Claim means any allegation, claim, demand, proceeding or cause of action.

Consequential Loss means indirect or consequential loss, including loss of profit, revenue, goodwill, reputation, anticipated savings or opportunity.

Content has the meaning given in clause 15.1.

Order has the meaning given in clause 6.1.

Product has the meaning given in clause 1.1.

Service has the meaning given in clause 1.1.

Website means Wristory’s website and any related pages, checkout, and customer account areas.

You means the person using the Website and/or placing an Order.
